The legal situation in Mexico
Mexico's Fintech Law limits regulated financial institutions to Banxico-authorised virtual assets, but exchanges outside that perimeter may operate subject to AML reporting. We found no privacy-coin-specific rule, and owning ZEC is legal. Local availability of ZEC is unverified.
Key facts
- 2018-03-09: The Fintech Law was published, defining virtual assets; fintech institutions may use only virtual assets authorised by Banxico.
- 2019: Banxico Circular 4/2019 barred regulated institutions from offering virtual-asset exchange, transfer or custody to customers; other entities, such as exchanges, are not barred.
- Virtual-asset transactions by non-financial entities are 'vulnerable activities' for AML purposes and must be reported above about USD 3,500.
- Tax: Individuals' gains from selling virtual assets are taxed as disposals of movable property under the Income Tax Law (ISR).
